Who Needs GST Registration?

Mandatory registration if:

  • •Annual turnover exceeds ₹20 lakhs (goods + services) in most states
  • •₹10 lakhs threshold for: Manipur, Mizoram, Nagaland, Tripura, Meghalaya, Sikkim, Arunachal Pradesh, Uttarakhand, Himachal Pradesh
  • •₹40 lakhs for goods-only businesses (not services) in most states
  • •You make interstate supplies (even below threshold)
  • •You're an e-commerce seller on Amazon/Flipkart (no threshold exemption)
  • •You're a casual taxable person
Voluntary registration: Below threshold, you can register voluntarily to claim Input Tax Credit (ITC) on purchases. Beneficial if you have significant business expenses.

Understanding Input Tax Credit (ITC)

ITC is the most powerful feature of GST — and the most misunderstood.

You can claim credit for GST paid on:

  • •Office rent
  • •Professional services (CA, lawyer, consultant fees)
  • •Software subscriptions
  • •Business laptops, equipment
  • •Raw materials, inventory
  • •Advertising and marketing
You cannot claim ITC on:

  • •Personal use items
  • •Food and beverages (for employees)
  • •Club memberships
  • •Motor vehicles (for personal use)
  • •Works contract for construction
ITC Example:

  • •You charge a client ₹1,00,000 + 18% GST = ₹1,18,000 collected
  • •You paid ₹10,000 GST on your office rent and software
  • •Net GST payable = ₹18,000 − ₹10,000 = ₹8,000
Without ITC, you'd pay ₹18,000. With ITC, only ₹8,000. This is why GST registration has value even if your turnover is borderline.

Common GST Mistakes That Invite Notices

1. GSTR-1 and GSTR-3B mismatch

Your GSTR-1 (sales) and GSTR-3B (payment) figures must match. Even ₹1 mismatch triggers a department notice. Reconcile before filing.

2. Claiming ITC without supplier filing

You can only claim ITC for invoices your supplier has declared in their GSTR-1. If your vendor hasn't filed, you have no ITC — even if you have the invoice. Always chase suppliers to file.

3. Reverse Charge Mechanism (RCM) not paid

GST on certain services (legal services, import of services, GTA transport) must be paid directly by the buyer under RCM. Many businesses miss this.

4. Late filing penalties

  • •Late fee: ₹50/day (₹20/day for nil return), maximum ₹5,000
  • •Interest on late tax payment: 18% per annum
  • •Repeated defaults can lead to registration cancellation

5. E-invoicing not done

Mandatory for businesses with turnover > ₹5 crore. Invoices not generated on IRP portal are invalid for ITC purposes.

GST for Freelancers: Practical Steps

1. Register on GST portal (gstin.gov.in) with PAN, Aadhaar, bank account

2. Get GSTIN (15-digit number = state code + PAN + entity code)

3. Raise invoices with your GSTIN, client's GSTIN, HSN/SAC code

4. File GSTR-1 by 11th (list all invoices issued)

5. File GSTR-3B by 20th and pay tax via netbanking

For freelancers earning ₹5-15 lakhs, GST compliance adds ~4-6 hours/month but enables ITC recovery that can exceed ₹20,000-50,000 annually.

E-Square Tip: We handle end-to-end GST compliance — registration, monthly filing, ITC reconciliation, and annual return. For a freelancer billing ₹10L+/year, professional GST filing costs less than the ITC you'd miss without expert help.
